These terms of use ("Terms of Use" or "Terms") outline the conditions under which users ("User") access and register on our website, mobile application, and identified studios and fitness centers (collectively referred to as the "Platform"), operated by HumanMovement Lab Private Limited ("Company"), and the Platform Services provided through the Platform. The terms "we", "our" or "us" refer to the Company. The terms "you", "your" or "yourself" refer to the User.

Please read the Privacy Policy carefully before using or registering on the Platform or accessing any material, information, or Platform Services through the Platform. Your use of the Platform or the Platform Services signifies your acceptance of the Terms of Use and Privacy Policy and your agreement to be legally bound by the same.

Products & Services

You acknowledge that the Platform allows you to avail services/buy products directly from the Company. We offer services through online mode via our website www.activityheals.com. The products and services available on the Platform include physiotherapy, treatment, kinesiology, human movement science, rehab, and recovery treatment consultations under the brand name 'Activity Heals'.

Acceptance of Terms of Use

These Terms and the Order set out the whole agreement between you and us for the supply of the Platform Services. To participate in certain Platform Services, you may be required to agree to additional terms and conditions. In the event these Terms of Use are inconsistent with such additional terms, the additional terms shall prevail.

Please ensure that the details in these Terms and on the Order are complete and accurate before you use or commit yourself to availing the Platform and or our Services. If you think there is a mistake, please ask us to confirm any changes in writing.

By using this Platform, Services or any Platform Services in any way, you agree that you have read, understood, and agreed to be bound by these Terms of Use available on our website and mobile application. If you disagree with the Terms of Use, you may cancel your Subscription Program.

As part of your use of the Platform, you consent to the collection, processing, storage, disclosure, and/or transfer of your personal information in accordance with the Privacy Policy. You further agree and confirm that the security practices and procedures implemented by the Company are reasonable and sufficient for the protection of your personal information.

The Company reserves the right to change or update these Terms, or any of our policies or practices, at any time and will notify users by posting such changed or updated Terms to www.Activity Heals.in. Your continued use of the Platform constitutes your agreement to abide by the Terms as modified.

Activity Heals shall use your Personal Information to ensure services with respect to the Platform are presented to you in the most effective manner, to secure the Platform and make improvements, to carry out our obligations to you, and to communicate with you.

Subscription Membership

To become a subscriber, you must be legally capable of entering into a binding contract and not barred from receiving Platform Services under applicable laws. You must register on the Platform by providing details about yourself, including your name, address, contact details, and other required details, and create an account.

Once a subscriber, you must ensure and confirm that the Account information and Payment Details provided by you are complete, accurate, and up to date. You will be responsible for maintaining the confidentiality of the Account information, including your password, and for all activities that occur under your Account. Use of another User’s Account information for availing the Platform Services is expressly prohibited.

Individuals under the age of 18 may utilize the membership/sessions/book a class only with the involvement and consent of the parent or legal guardian and subject to these Terms of Use. The parent or legal guardian of such Minor agrees to indemnify, defend, and hold harmless the Company and its business partners from any claims arising from the use of the Platform Services by the Minor.

Payment Services Schedule and Refunds:

All payments in respect of the Platform Services shall be made to the Company through the Platform. The Company may use third-party vendors and service providers, including payment gateways, to process payments and manage payment card information.

When making payments online, you undertake to use a valid payment card or bank details, or third-party wallets or details required for any other mode of payment with the authority to use the same and ensure sufficient funds or credit are available to complete the payment on the Platform.

The payment receipt and transaction summary shall be provided by the respective mobile app marketplace or by the Company and will be made available on the Platform and sent to your registered email address.

No refund is provided for the cancellation/no-show of your appointment.  Our therapists would have arranged their day to dedicate time to you and we expect the same commitment from you.  In the realm of rehabilitation, the prep work and journey to recovery is often a long and winding road. There will be days when the path feels more arduous than others, and moments when your body aches in unexpected places. Picture your recovery as a Rubik's Cube, where numerous permutations must be constantly adjusted and aligned to match your unique pace and endurance towards the desired goal.

Any payment, in part or full, constitutes an acceptance/agreement the terms and conditions, indemnification, and waiver mentioned herein.

 

On Insurance Based Payment:

No one is more delighted than we are when you choose to utilize insurance to cover your recovery and regain the quality of life you so richly deserve. Some insurance providers do offer coverage for pre-surgery rehab, which can be an excellent advantage. However, we do not currently have a cashless facility available. This means you will need to make the full payment for your rehab upfront and then submit the invoice to your insurance provider for reimbursement.

 

Once we have received the full payment from you, we will issue an invoice in accordance with legal requirements, allowing you to seek reimbursement from your insurance provider. It is important to note that if you choose to cancel or discontinue your sessions with us for any reason after availing insurance coverage or reimbursement, you will not be entitled to any refund or reversal of the amount paid.  It will be considered as forfeited. 

 

To prevent any potential disappointment or frustration, we strongly encourage you to speak with your insurance provider beforehand to understand the specifics of your coverage. This will ensure a smooth process and allow you to focus entirely on your journey to recovery without any unforeseen financial concerns.

Release and Indemnification

You release, waive, and forever discharge any claims you may have against the Company, its affiliates, and their respective representatives, directors, officers, independent contractors, consultants, agents, employees, or volunteer staff arising from your use of the Platform Services.

You agree to indemnify and hold harmless the Company from any loss or liability incurred due to unauthorized use of your Account, the accuracy of the information you provide, and your compliance with these Terms.

Use of Platform

Subject to compliance with the Terms of Use, the Company grants you a non-exclusive, non-transferable right to access and use the Platform and Platform Services. You agree to use the Platform for personal, informational, and internal purposes in accordance with applicable laws and regulations.

By accessing the Platform, you consent to receive communications from the Company and its affiliates, which may include special offers, marketing, surveys, and Platform-based communication emails. You can opt-out by contacting us.

Feedback

You agree to provide honest feedback or reviews about the Platform Services as required by the Company. You acknowledge that you may be exposed to content from others that you may find offensive or objectionable, and the Company disclaims all liabilities arising in relation to such content.

Prohibited Uses

You agree not to engage in activities that are unlawful, abusive, or disruptive to the Platform. This includes defaming, harassing, or violating the legal rights of others, interfering with the proper functioning of the Platform, and uploading files that contain viruses.

Intellectual Property Rights

The Platform and its content are owned by the Company and/or its licensors and are protected by intellectual property laws. You are not permitted to use the content without prior consent.

If you believe the Platform violates your intellectual property, notify the Company with details of the alleged infringement.

​

General Terms and Conditions

The Platform and Platform Services are provided on an "as is" and "as available" basis without warranty of any kind. The Company disclaims all warranties, including the accuracy and reliability of the Platform and Platform Services.

You agree to indemnify the Company against any claims arising from your use of the Platform or violation of these Terms. The Company shall not be liable for any damages resulting from the use of the Platform or Platform Services.

Consent and Release

By participating in sessions at Activity Heals, you consent to the evaluation and treatment procedures. You acknowledge the risks involved and agree to fully cooperate with the treatment program. You have the right to ask questions and discuss potential risks and benefits of the treatment.

The Company may videotape or have professionals observe the treatment for educational purposes, ensuring your confidentiality is protected. In case of disputes, the matter shall be resolved under the laws of India through arbitration.

Communications and Notice

You agree to receive communications from the Company. You can unsubscribe by emailing us. Notices from the Company will be served via SMS, email, or notifications on the Platform.

 

Assignment and Waiver

You cannot transfer the Terms of Use to any third party without the Company's consent. The Company can freely transfer its rights under the Terms. Any failure by the Company to enforce any provision of the Terms does not constitute a waiver of that provision.
